The PPH (Patent Prosecution Highway) works well in Canada
Unlike in most other jurisdictions, the Patent Prosecution Highway works very, very well for cost-effective prosecution of patents in Canada. the reason is simple: in Canada, examination is deferred at no cost and without effort for up to 5 years. This allows time to prosecute your claims to allowance in a corresponding jurisdiction such as the USPTO or EPO.
- File your Canadian application as normal, including claiming priority under the Paris Convention or PCT.
- Do not request examination (deferral without cost or effort for up to 5 years).
- Prosecute elsewhere.
- Upon allowance elsewhere, voluntarily amend Canadian claims to conform to allowed claims elsewhere, request examination in Canada, invoke the PPH.
- Usually, within 60-90 days received your allowed Canadian patent.
